Sailing 18' sailboats in the Penobscot Bay during summers after dark when
we got caught still out on the water, was a simple pleasure in the 50's and
60's. We were required to carry flashlights as we had no motors or
generators. However, when one heard a motor approaching, we turned our
flashlights on and pointed them at the sails. Trying to point a beam into the
eyes of a motor boat driver wasn't as effective as shining a light on a twenty
foot tall flag.

I am relieved to hear that Bismark Dinius was acquitted of all charges, I am however concerned and outraged that the drunk officier who clearly was at fault was never charged. I think this is a clear case of the police covering up to protect their own. They were certainly quick to pass the blame off. This brings shame to all honorable law enforcement!

I can't even believe this case!  Rhetorical Question:  What if no one was at the helm of the sailboat and running lights off and they were just floundering around etc.?  The guy who mowed down that sailboat is clearly, obviously directly at fault - only !

If a boat is sinking (foundering, without the 'l') then it's an entirely different matter.

A boat capable of being controlled and not being handled as such would be quite a different situation. Obviously there would be a lot of other deciding factors.

Neither example applies to this particular case.

I entered "Deputy Perdock + Lake County, CA" on Google and found this link, which said that the deputy is the subject of an internal affairs investigation for misconduct:

Be sure to look at the pictures and video. If you want to dig deeper, keep looking. There were more than 2,000 entries, if you want to wade through all that. Gee, thanks Google. Nothing yet to say anyone is going to be charged or lose their job. I hope BoatUS will continue to follow this and report back if either of those things happens.

The link did not work for me, but I started reading the local newspaper, the "Lake County News".  You may remember that I have discussed the importance strong leadership of PD's and SO's to maintain a culture of service and professionalism.  Not surprisingly, this Sheriffs Office (SO) has lots of problems.  Several on-going investigations.  A 20 year deputy crashed a helicopter that was rented under a pot eradication program financed through a grant from the DEA at a cost of 275K a year.  He was a student pilot, working on hours toward a commercial license.  Personal hours, in county rented aircraft, on county time.  He also purchased flight suits and attended flight safety classes at county expense.  Expenses not approved for others that were actually involved in the flight program.  Anybody surprised?  And now they just took delivery of new helicopter, purchased by guess who? Us the federal taxpayer.  The only good news is that it appears that the Sheriff has his first strong compitition for election in 20 years.  Hopefully he wil be out in 2010 and the new one will clean house.

After I saw Chief Mike's post, I tried the link again as it appeared on this page, and it didn't work for me today. When I tried to find it on Google, I quickly found it and saw that somehow there was an unwanted space in the address published here. I also noted that there were nearly 100 less items than I found last night by conducting the same search. Go figure. Here's the correct address... I hope you can get it to work now...it worked for me:

(There's no space between the 6 and 9 in the address. If it shows one when you copy and paste into your browser, just delete the space before you start the search. Computers are stupid that way.)

Now is the time for Dinius to file civil charges against Perdock. You can bet that a lot of attorneys will be interested in representing Dinius.

As for the drinking issue, it seems to me that ignorance, carelessness, arrogance, and temperaments are responsible for more deaths. Drinking is just easier to blame.

I am pretty sure he already has.  This case is a lawyers dream.  The family of the woman that was killed is suing absolutely everybody, Dinius, Perdock, the owner of the boat, the county, and others.

I think I'll sue that County for causing me to lose faith in our criminal justice system.

Right after I settle the suit with Miller for selling me lite beer that still made my pot belly grow.
